Case Review (Appeal, Independent Review, Public Inquiry)

Michael J L Turner acted as an expert witness on computer data used as evidence in well over 200 cases in the criminal and civil courts between 1988 and 2018 - throughout the rapid development of Best Practice in computer forensics.

He can review and advise on the interpretation and evaluation of computer evidence including:

  • Integrity of handling computer evidence
  • Findings of previous forensic investigations
  • Distinguishing between fact, speculation, assumption, inference and expert opinion
  • Best Practice in digital forensics - accepted, novel or junk science?
  • Certainty of evidence

He is prepared to advise pro bono where the misuse of computer evidence in court proceedings may have resulted in a miscarriage of justice.

Computer Misuse Act 1990

Michael can advise on Computer Misuse Act 1990 cases in the light of his knowledge of historic CMA cases and his experience as an expert witness. Since 1992 he has maintained the definitive index of Computer Misuse Act 1990 case law and statistics that the Crown Prosecution Service describe as "useful". He has also been actively involved in the Criminal Law Reform Now Network review of the current law and has contributed to its report Reforming the Computer Misuse Act 1990 published in January 2020.

Expert Determination of disputes about computer evidence

Michael J L Turner has extensive experience of acting under joint instructions - as a single joint expert and as an arbitrator, mediator, ADR neutral and as an expert to determine disputes. He can provide Expert Determination of disputes such as:

  • Questioned Digital Documents - authenticity, integrity, chronology of amendments, authorship
  • Contested Expert evidence - interpretation and evaluation of digital evidence
  • Software Copyright infringement - literal copying of software development material including source code
